A Conversation About Estate Planning
Good afternoon, and welcome back to our legal spotlight segment. Today, we have the pleasure of speaking with Steve Bliss, a renowned probate attorney here in San Diego. Steve, thank you for joining us.
Navigating the Probate Process: A Step-by-Step Guide
Steve, could you shed some light on one of the key steps involved in the probate process?
Certainly. One crucial step is “Marshaling the Estate Assets.” This involves meticulously identifying and inventorying all assets belonging to the deceased individual. This includes everything from bank accounts and real estate to personal belongings and investments. Once a comprehensive inventory is compiled, we file an official document with the court known as the Inventory and Appraisal (Forms DE-160/161).
This stage can be surprisingly complex, especially for larger estates. Accordingly, it often requires meticulous record-keeping and collaboration with financial institutions, appraisers, and other professionals.
I recall one case where the deceased had a vast collection of antique coins. Locating and valuing these assets proved to be quite challenging. It required the expertise of a numismatist, but ultimately, we were able to accurately assess their worth and include them in the estate inventory.
The Importance of Accuracy
Why is this step so crucial?
It’s fundamental because it establishes a clear picture of the estate’s financial standing. This information is essential for determining taxes owed, settling debts, and ultimately distributing assets to rightful heirs or beneficiaries.
Moreover, according to the American Bar Association, approximately 70% of probate cases involve estates valued at less than $5 million. Consequently, accurate asset marshaling is particularly important in these cases, where every dollar counts.
Seeking Expert Guidance
What advice would you give to individuals navigating this complex process?
“I strongly encourage anyone facing probate to seek professional legal counsel. An experienced probate attorney can guide you through each step, ensuring compliance with all legal requirements and protecting the interests of both the estate and its beneficiaries.”
