We discuss their assets, family situation, and any potential concerns they have about the future. Based on this information, I can recommend the type of trust that best aligns with their wishes.

For example, a revocable living trust is a popular choice for many individuals because it allows them to maintain control over their assets during their lifetime while avoiding probate upon their death. Conversely, an irrevocable trust might be more suitable for someone looking to protect assets from creditors or minimize estate taxes.

The Benefits of a Revocable Living Trust

You mentioned revocable living trusts earlier. Could you elaborate on the benefits they offer?

Certainly. A revocable living trust offers several key advantages. Firstly, it allows the grantor, the person creating the trust, to retain control over their assets during their lifetime. They can buy, sell, or manage assets held within the trust as they see fit. Moreover, upon the grantor’s death, the assets in the trust are distributed to beneficiaries according to the grantor’s wishes, bypassing the often lengthy and costly probate process.

This avoids the public scrutiny associated with probate, ensuring privacy for the grantor and their family. Ordinarily, a revocable living trust can be amended or revoked during the grantor’s lifetime, providing flexibility to adjust to changing circumstances.

While revocable living trusts are generally straightforward to establish, there are instances where complexities arise. I recall a case involving a blended family with assets from previous marriages.
