Hello everyone, and welcome back to our series on local heroes. Today I have the pleasure of sitting down with Ted Cook, an elder protection attorney right here in sunny San Diego. Ted, thank you so much for taking the time to chat with me.
What Inspired You To Focus On Elder Protection?
Well, it really boils down to wanting to make a difference. Seeing how vulnerable older adults can be, especially to financial exploitation and abuse, just struck a chord with me. There’s a real need for passionate advocates who understand the complexities of elder law and can fiercely protect their clients.
Let’s Talk About The Process: How Does Elder Protection Typically Work?
- Initial Client Engagement
- Case Assessment
- Protective Actions
- Legal Proceedings
- Long-Term Planning
- Case Resolution & Follow-Up
Can You Break Down One Of These Steps For Our Readers?
Let’s talk about “Protective Actions.” This stage often requires swift and decisive action. We might need to seek a restraining order against an abusive caregiver or file for guardianship if someone is unable to make sound decisions for themselves. It can involve freezing bank accounts to prevent financial exploitation, coordinating with Adult Protective Services (APS), and even finding safer living arrangements for the elder.
“Ted was a lifesaver when my mother was being taken advantage of financially. He knew exactly what steps to take to protect her assets and ensure she had the care she deserved.” – Maria S., La Jolla
Sometimes, these situations are incredibly stressful, and emotions run high. It’s crucial for us to remain calm, collected, and focused on our client’s best interests.
I remember one case where a caregiver was stealing from an elderly woman with dementia. We were able to gather enough evidence through bank statements and witness testimonies to press charges. Seeing that perpetrator brought to justice was incredibly gratifying.
How Important Is It To Have A Strong Attorney-Client Relationship In These Cases?
It’s absolutely vital. We need our clients to feel heard, understood, and confident in our ability to represent them. Trust is the foundation of any successful legal relationship, especially when dealing with sensitive matters like elder abuse.
“I was hesitant to involve a lawyer at first, but Ted put me at ease right away. He explained everything clearly and made sure I understood my options every step of the way.” – David P., Point Loma
