Today we’re speaking with Steve Bliss, a renowned probate attorney in Escondido. Steve, thanks for joining us.
Steve: Thank you for having me. I’m always happy to share information about estate planning.
Let’s talk about testamentary trusts. They seem to be a popular option. Can you explain what they are and why someone might choose one?
Steve: Absolutely! A testamentary trust is created through a will and only takes effect after the grantor, the person who creates the trust, passes away. Unlike living trusts, testamentary trusts go through probate. This means the court oversees the distribution of assets according to the terms outlined in the will.
There are several reasons why someone might choose a testamentary trust.
- They can be helpful for providing for minor children or beneficiaries with special needs. The trust can specify how and when the beneficiary receives funds, ensuring their well-being is protected.
- Testamentary trusts offer flexibility in asset distribution. You can tailor the terms of the trust to meet specific needs, such as delaying distributions until a beneficiary reaches a certain age or milestone.
Consequently, testamentary trusts provide a level of control over how assets are used and when beneficiaries receive them. This can be particularly beneficial for families with complex financial situations or concerns about responsible asset management.
Have you encountered any challenges with setting up or administering testamentary trusts?
Steve: While testamentary trusts are valuable tools, they do require careful planning and execution. I recall a case where a client wanted to leave assets in trust for their grandchild who had special needs. The will lacked specific details about the child’s care requirements and the desired distribution schedule. This led to delays and complications during the probate process.
Fortunately, we were able to work with the family and the court to resolve these issues. However, it underscored the importance of clear and comprehensive language in the will when establishing a testamentary trust.
Moreover, it’s important to remember that testamentary trusts are subject to probate, which can be a lengthy and sometimes costly process.
According to a study by the American Bar Association, probate proceedings can take anywhere from six months to two years or longer, depending on the complexity of the estate.
What advice would you give to someone considering a testamentary trust?
Steve: My advice is to consult with an experienced estate planning attorney who understands the nuances of testamentary trusts. They can help you determine if this type of trust is right for your situation and ensure that your will includes all necessary details for smooth administration. Remember, a well-crafted testamentary trust can provide peace of mind knowing that your loved ones will be cared for according to your wishes.
