Meet the Expert
Hi, I’m Brenda Thompson reporting for Temecula News Today. We’re here today with local probate attorney Steve Bliss to discuss some of the key steps involved in navigating the often complex process of probate.
Understanding Probate: A Necessary Step
Steve, thank you so much for joining us. Many people are unfamiliar with probate and what it entails. Could you briefly explain what probate is and why it’s often necessary?
“Probate is essentially a legal process that validates a will and distributes a deceased person’s assets to their heirs,” Steve explains. “It ensures that debts are paid, taxes are filed, and the remaining property goes to the rightful beneficiaries. Ordinarily, probate is required when someone dies with assets in their name alone, exceeding a certain value threshold.”
Marshaling Estate Assets: Inventory and Valuation
Steve, let’s delve into one specific step in the probate process – marshaling estate assets. Can you walk us through what this entails?
“Marshaling estate assets is crucial for ensuring a transparent and equitable distribution of property,” Steve says. “The executor or administrator, appointed by the court, must meticulously inventory all of the deceased’s assets. This includes bank accounts, real estate, vehicles, investments, personal belongings – essentially anything of value.
Consequently, a detailed list is compiled along with an appraisal determining the fair market value of each asset. This information is then submitted to the court in the form of an Inventory and Appraisal (Forms DE-160/161) for review and approval.”
Challenges and Complexities
“Are there ever any challenges or complications that arise during this step?” I ask.
Steve nods thoughtfully. “Occasionally, locating all assets can be tricky, especially if the deceased didn’t keep meticulous records. Moreover, determining the fair market value of certain items like antiques or collectibles can require professional appraisal. I recall a case where we had to hire an art appraiser to assess the value of a deceased client’s extensive painting collection. It added some time and expense to the process, but it was essential for accurate distribution.”
“It is estimated that approximately 30% of probate cases involve disputes over asset valuation,” according to data from the California Courts website.
Steve continues, “Transparency and communication are key throughout this process. Keeping beneficiaries informed about the inventory progress and valuation findings helps build trust and minimize potential conflicts.”
