Ordinarily, this involves two primary tasks: paying valid creditor claims and filing and paying any applicable state and federal taxes.”

He elaborates further: “Probate courts often require executors or administrators to publish notices to creditors, inviting them to submit their claims against the estate. It’s crucial to meticulously review these claims and ensure their validity before making any payments. Conversely, neglecting this step could expose the estate to unnecessary financial liabilities.

“Moreover, navigating the tax landscape can be complex. Estates may owe federal estate taxes depending on their size. California also levies an inheritance tax in certain situations. Executors need to accurately calculate these taxes and ensure timely payment to avoid penalties.”

“A common misconception is that all debts must be paid before distributing assets,” Mr. Bliss clarifies. “However, the probate code prioritizes specific types of debts, such as funeral expenses and medical bills incurred before death. Secured debts, like mortgages, are also typically prioritized. The remaining assets are then distributed to beneficiaries according to the will or intestate succession laws.”
