What initially drew you to focusing on elder protection law?
It’s a great question. For me, it wasn’t so much one thing as it was a combination of factors. I’ve always been passionate about social justice and helping those who are most vulnerable. Elders often face unique challenges, whether it’s financial exploitation, abuse, or neglect. It’s incredibly rewarding to be able to use my legal skills to protect them and ensure they are treated with the dignity and respect they deserve.
Can you walk us through the typical steps involved in the Elder Protection process?
Absolutely. I like to think of it as a roadmap that guides us towards protecting our clients. We start with an initial consultation where we get to know the client, understand their situation, and assess any immediate risks. Then comes a thorough case assessment where we identify the legal issues involved, gather evidence, and evaluate the level of threat. Based on that evaluation, we take protective actions which could include anything from filing restraining orders to pursuing civil litigation. Throughout the process, communication is key, and we work closely with our clients to keep them informed and empowered.
Ted can you elaborate on “Protective Actions” and the various strategies involved?
That’s a crucial stage because often it involves immediate intervention to safeguard the individual.
Let’s say someone is experiencing financial exploitation by a family member. We might initiate emergency legal remedies, like freezing bank accounts or seeking a temporary restraining order to prevent further harm.
If an elder is suffering from neglect in their care facility, we could work with Adult Protective Services (APS) to investigate the situation and ensure they are moved to a safe environment.
In cases of physical abuse, we might seek a guardianship or conservatorship to protect the individual’s well-being and make decisions on their behalf.

Sometimes, the biggest challenge is overcoming resistance from family members who may be involved in the abuse or exploitation. It can be emotionally charged and difficult to navigate those relationships while still advocating for our client’s best interests.
